This will cover additional staff and the days/hours of work before the sale. Whimsical Mementos will be in and out of the house daily in the days up to the sale. This also covers the time needed after cleaning up the post-sale home. During the time of preparation of the sale and during the sale there cannot be anyone/or pets living in the residence. This helps eliminate unforeseen situations for both the company and the estate. Also ensuring that Whimsical Mementos staff have ample time to sort, stage and list items before the sale. This ensures a better outcome for the sale and the Estate. If this becomes an issue, we as a company reserve the right to cancel the sale and the Estate will agree to pay $50 an hour for the time put in at that point and the costs of the listings. ____(Initial)

Online Sales terms:

Whimsical Mementos commission for items listed on eBay: 40% after

eBay takes fines and fees per item. The seller will receive 45% from the    eBay sales. Items listed on Marketplace will be paid out to the estate in the final payment with the original commission payment plan.

Terms and conditions for the sale:

Agreement for Date to Start:

The Seller(s)/Owner(s) of the Estate agree to be finished in the home by: ______________ This is to allow for proper time to set up and sort for the sale. On the decided date all access to the home will be limited to the real estate agent only if needed. After this date NO items will be removed from the estate to allow for Whimsical Mementos to be able to efficiently set up. This helps to ensure the best pricing and outcome for both the estate and the company. All keys and openers should be limited to the Executor of the estate and Whimsical Mementos to help limit people coming through the house during prep. If any additional care needs to be done to the home during the period of prep the Executor will assist with arrangements and times. The yard and walkways will need to be tended to by the estate before the sale.  If items are removed from the estate, we as a company will have to assess if the sale will continue as planned based on what’s left in the estate. If it is determined there is enough value in the estate to continue the sale, we will provide a fair evaluation of the items removed and assess 45% of that value to be paid to Whimsical Mementos after the sale. If the sale is canceled the estate will agree to pay $50 per man hour for the hours worked up to that date. ______(initial)

Partial Picker Sale guidelines:

Since this is a partial picker sale items that are individually priced will be done so at the current market value to be determined by Whimsical Mementos. These items will include furniture and higher valued items. Anything that is not priced will be make a pile and we make the price. We have specific cards that we use for this, so the checkout knows the prices are ours. If these items don’t sell by Saturday. The options are to reduce the price on Sunday____ or leave and list online after the sale_____.

The set up before the sale:

The days/month before the sale we will be in and out the house to clean, set up and sort items in the home. During this time, we will do research on higher end items that we may sell online to get the best price for the family. If they don’t sell before the date the items will be priced and placed in the set-up area by check out. During this time the Family will be asked to not remove items in the home to ensure the best outcome for the sale. If items are removed an assessment will be made to see if the sale will continue as planned per the contract.

The day of the Sale:

We will accept Credit cards and cash at the sale. There will be a 3% fee for credit cards to cover the service fees. No checks will be accepted during the sale. The cost of listing on Estatesales.net and any other paid advertisement will be taken from the sale funds before paying the price will be around $150. The online Estate sites this will send photos and info out to potential sellers thru email the address will be included for the email. The sale will be listed on several pages through Facebook. Seller(s) are welcome to share the sale when it’s posted. The address of the Estate Sale will not be posted on Facebook till the day before. On the day of the sale if any family members and/or seller(s) wish to have additional property from the estate they will purchase the items and pay at the sale. At the end of the sale within (date)________the seller(s) will receive payment from the sale, credit card sales will take up to 3 days to clear the bank, there will NOT be an itemized list for the items sold based on the pace of the sale. There are certain banks currently placing 10-20 day holds on checks. Whimsical Mementos are not responsible for the hold on the check on the Estates end. ____ (Initial) There will be one person dealing with the cash and cards at the sale and one person giving the prices.  On the day before the sale signs will be posted for the advertisement. The seller(s) are NOT responsible for accidents that happen to the workers of Whimsical Mementos. The seller(s) owners ARE liable for any injuries that occur at the sale to buyers.

Clean up and trash removal:

Once we have looked over the house the decision will be made on how much trash and cleaning will need to be done for the sale. Whimsical Mementos will not remove/dispose of any building materials in the home. If it is necessary, that building materials be removed it will be at the cost of the Estate and removed from the sales profit before payment. Whimsical Mementos will not removal Hazordious materials from the home. That will be left for the Estate owners to handle. If there is animal waste and/or human waste an additional cost of $300 will be removed from the sales profit before payment. This will cover the cost of bleach, gloves and other cleaning supplies needed to properly clean the area. If there is an issue with infection control, we will need to be notified upon signing the contract so items can be purchased and discussed. If the trash removal is considerable (to the point a trailer or multiple hauling’s to the dump are needed) trash removal cost will be removed from the total sales before payment to the estate. We will use any cleaning items and trash bags in the home during prep and post estate sale if they are needed and not able to be sold.  When the estate sale is completed, we will do our best to make sure the home is tidy and clean. _____(Initial)

The End of the Sale:

At the completion of the sale the left-over items can be:

Donated to Goodwill with the work done by Whimsical Mementos at the cost of the seller(s) for $40 an hour.

Taken to an auction group for an online sale with pickup in the Estate on a decided date: _______ The commission for the seller(s) would be 20%. Whimsical Mementos will take 50% and the auction group will take 30%. Whimsical Mementos will handle the listing of the items and photos. Whimsical Mementos will handle pickup for the items at the Estate when the auction is completed. Pick up is usually Thurs eve and Friday eve the week of the online sale.

Whimsical Mementos will purchase the remaining items at a flat price and will have ________ amount of time after to remove items.

If the seller selects the buyout option, all items inside the home are to be removed by Whimsical Mementos. With the buyout they become the property of the Estate Company. This includes everything remaining from the sale. We will do a final walk through with the family to see if there are any additional items they would like to have. After the offer is made everything will be the estate sale companies. The large items listed below are wanted by the family and to be removed by them.

Whimsical Mementos Estate Sale Expectation’s

The time before the sale we will come in and sort items. During this time, we will place like items together and sort through stuff. We will dispose of the trash before the sale. Any items that need to be looked at by the seller(s) will be placed in a specific space and asked to be looked at 2 days before the sale. Items will be stored throughout the home are being used for the sale. The other areas will be taped off for the sale and the restrooms as well. There are NO public restrooms for the sale. The day of the sale employees will be identified with tags and/or shirts. They will be placed throughout the areas to assist and keep an eye on shoppers, the higher priced area is beside the check out. Buyers who purchase any furniture will remove it from the estate at their own risk and on their own. They will be asked to have items removed no later than the end of the sale on the third day. Buyers will be expected to have their own boxes and ways to get items out of the home. The boxes that are in the home can be used by the buyers till they run out. Neither the seller(s) or Whimsical Mementos are responsible or expected to provide boxes or bags for the sale.  There will be posted signs about liability and information on credit cards and cash purchases.
